Terms of Use

1. Who we are, and agreeing to these terms
These terms are an agreement between you and Anton Savytski, a sole proprietor carrying on business as Anatoli Labs in Toronto, Ontario, Canada (“Anatoli Labs”, “we”, “us”). They cover the Mailroom app for macOS, its updates (“Mailroom”), and this website.
By downloading, installing or using Mailroom, or by using this website, you agree to these terms and to our Privacy Policy. If you don’t agree, don’t download or use Mailroom. If you use Mailroom for an organization, you agree on its behalf and confirm you’re allowed to.
2. Your licence to use Mailroom
We give you a free, personal, non-exclusive, non-transferable, revocable licence to install and use Mailroom on Macs you own or control, for personal or business use. We keep all rights we don’t expressly give you, including in Mailroom’s name, icon and design.
You agree not to:
- sell, rent, lease or sublicense Mailroom, or charge others for access to it;
- distribute modified copies of Mailroom, or present any other software as Mailroom;
- remove or change any notices in Mailroom; or
- use Mailroom to break the law, to send spam or harassing messages, or to access accounts you’re not authorized to use.
Mailroom includes open-source software that’s licensed under its own terms, and those licences apply to those parts. If we publish Mailroom’s source code under an open-source licence, that licence governs your use of the source code.
3. Your accounts, your mail, and backups
Mailroom connects to services you choose, such as your email, calendar and contacts providers, sign-in providers, and AI services. Those services are run by others, under their own terms, and we don’t control them or answer for them. You’re responsible for your accounts and passwords, for keeping your Mac secure, for the messages you send, and for following your providers’ terms and the law.
Mailroom acts on your instructions and changes what’s stored on your providers’ servers: it can send, delete, move and flag messages, and change events and contacts. A fault in Mailroom, in a provider’s service, or in your connection could cause messages or other data to be lost, changed, duplicated, not delivered, or sent at a different time. Deleted mail may not be recoverable. Keep your own backups of anything that matters to you.
4. AI features
Mailroom’s AI features are optional and run only when you ask. When you use them, the text of the message or conversation is sent to the AI service you set up, under that service’s terms, and any charges from it are yours. AI suggestions, translations and summaries can be wrong, incomplete or inappropriate. Review them before you rely on them or send them. You’re responsible for what you send and for decisions you make with them.
5. Free, and no promise of support
Mailroom is free. We aren’t obliged to provide support, updates or fixes, and we may change, suspend or stop offering Mailroom or this website at any time, without notice.
6. No warranty
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAILROOM AND THIS WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS, AND WITHOUT WARRANTIES, CONDITIONS OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, INCLUDING ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DON’T WARRANT THAT MAILROOM WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT IT WILL PRESERVE YOUR DATA, THAT IT WILL WORK WITH ANY PARTICULAR SERVICE, OR THAT ANY DEFECT WILL BE CORRECTED. YOU USE MAILROOM AT YOUR OWN RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICES OR LOSS OF DATA THAT RESULTS FROM USING IT.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ANATOLI LABS, ANTON SAVYTSKI, OR ANYONE WHO HAS CONTRIBUTED TO MAILROOM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, MESSAGES, PROFITS, REVENUE, BUSINESS, GOODWILL OR OPPORTUNITY, ANY COST OF REPLACEMENT SOFTWARE OR SERVICES, OR ANY UNAUTHORIZED ACCESS TO OR CHANGE OF YOUR DATA, ARISING OUT OF OR RELATING TO MAILROOM, THIS WEBSITE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN TOLD OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO MAILROOM, THIS WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR MAILROOM IN THE 12 MONTHS BEFORE THE CLAIM (WHICH, FOR A FREE APP, IS NOTHING) AND TEN CANADIAN DOLLARS (CAD $10). THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
8. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Anatoli Labs and Anton Savytski from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to your use of Mailroom, the messages and content you send or receive with it, your breach of these terms, or your breach of any law or anyone else’s rights.
9. Where the law doesn’t allow these limits
Some places don’t allow certain warranties to be excluded or certain liability to be limited, for example for death or personal injury caused by negligence, or for fraud. In those places, sections 6, 7 and 8 apply only to the fullest extent the law allows, and nothing in these terms limits rights you have under consumer protection laws that can’t be given up by agreement.
10. Ending your licence
You can stop using Mailroom at any time by deleting it. Your licence ends automatically if you break these terms. Sections 3, 4 and 6 to 13 continue to apply after your licence ends.
11. Changes to these terms
We may update these terms. We’ll post the new version here and change the date at the top, and note material changes in the release notes of the next version. If you keep using Mailroom after a change takes effect, you accept the updated terms. If you don’t accept them, stop using Mailroom.
12. Governing law and disputes
These terms, and any dispute arising out of or relating to Mailroom, this website or these terms, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You and we agree that the courts located in Toronto, Ontario have exclusive jurisdiction, except where the law where you live gives you a right to bring a claim in your local courts that can’t be given up by agreement.
13. General
- These terms and the Privacy Policy are the entire agreement between you and us about Mailroom and this website, and replace any earlier understanding.
- If any part of these terms is found unenforceable, it will be enforced to the extent possible, and the rest stays in effect.
- If we don’t enforce a part of these terms, we haven’t waived our right to enforce it later.
- You may not transfer these terms to anyone else. We may transfer them, for example to a company we form or to whoever takes over Mailroom.
- Headings are for convenience only.
- You and we have asked that these terms and all related documents be drawn up in English. Vous et nous avons exigé que les présentes conditions et tous les documents qui s’y rattachent soient rédigés en anglais.
